These Terms of Use (“Terms”) govern your access to and use of the website operated by The Palace Restoration Project (“we,” “us,” or “our”), including pages served from thepalace.app and related paths (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
What the Site is
The Site provides information about The Palace, our nonprofit activities, and links to software downloads, directories, and community resources hosted elsewhere. The Site itself does not host Palace chat sessions. Your use of any Palace client, server, or third‑party service is separate and may be subject to additional terms from those providers.
Acceptable use
You agree not to misuse the Site. Without limitation, you will not: attempt to gain unauthorized access to our systems or other users’ data; interfere with or disrupt the Site; use automated means to scrape or overload the Site without permission; upload malware or harmful code; or use the Site to violate applicable law or infringe others’ rights.
Intellectual property
Content on the Site (text, graphics, logos, and layout) is owned by us or our licensors and is protected by copyright and other laws, except where noted. You may view and print reasonable portions for personal, non‑commercial use. You may not reproduce, modify, distribute, or create derivative works without our prior written permission, except as allowed by law.
Third‑party links and software
The Site may link to third‑party websites, downloads, or services. We do not control and are not responsible for third‑party content, availability, or practices. Use of third‑party software or services is at your own risk and subject to their terms and licenses.
Disclaimer of warranties
The Site and all information on it are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Site will be uninterrupted, error‑free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, The Palace Restoration Project and its directors, volunteers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site or inability to use the Site. Our total liability for any claim arising out of these Terms or the Site will not exceed the greater of (a) fifty U.S. dollars or (b) the amounts you paid us for use of the Site in the twelve months before the claim (which is typically zero for a free informational site).
Indemnity
To the extent permitted by law, you agree to defend and indemnify us against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site.
Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Changes
We may modify these Terms at any time by posting an updated version on this page and updating the effective date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
General
If any provision of these Terms is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms are governed by applicable federal law of the United States and the laws of the state in which The Palace Restoration Project is organized or principally operates, without regard to conflict‑of‑law principles. Disputes arising from these Terms or the Site should be brought in the courts of that state, except where mandatory law gives you the right to sue in your home jurisdiction.
